These terms govern the supply, fabrication and installation of stone products by Apelux Pty Ltd ("Apelux", "we", "us") to you ("the Customer"). Please read them carefully — by accepting a quote or placing an order, you agree to these terms. Nothing in them limits rights you have under the Australian Consumer Law that cannot lawfully be excluded.

These terms

These terms, together with your accepted quote and any design drawings we issue, form the entire agreement between you and Apelux. They prevail over any other terms unless we agree otherwise in writing. If any part is found to be unenforceable, the remaining terms continue to apply.

Quotes & orders

Quotes are valid for 30 days from the date of issue unless stated otherwise, and are based on the information and measurements available at the time. An order is confirmed once you accept the quote in writing and pay the required deposit.

Where final on-site measurements or design changes alter the scope, we will issue a revised quote for your approval before proceeding.

Pricing & payment

All prices are in Australian dollars and include GST unless stated otherwise. Catalogue prices shown per square metre are for supply only; fabrication and installation are quoted per project.

  • Deposit — 50% of the total is payable to confirm your order and schedule fabrication.
  • Balance — the remaining 50% is payable on completion of installation, unless otherwise agreed.
  • Trade accounts — separate payment terms apply as set out in your trade agreement.

We may pause work where an invoice is overdue. Title in goods does not pass to you until payment is received in full (see Title & risk).

Samples & natural variation

Porcelain stone is a manufactured product designed to emulate natural stone. Colour, veining and pattern vary from slab to slab and may differ from samples, showroom displays and on-screen images.

Important

Samples and website images are a guide only. Variation in tone, veining and pattern is a natural and expected feature of the product, and is not a defect. Where bookmatching or vein direction is critical, please confirm this in writing during design.

Measurement & site access

Final fabrication is based on measurements taken by Apelux at your site, or on measurements you supply and confirm. Where you supply measurements, you are responsible for their accuracy.

You agree to provide safe, clear and timely access to the site, with cabinetry, services and substrates ready for installation. Delays or additional visits caused by the site not being ready may incur additional charges.

Lead times & delivery

Indicative lead times are typically 10–14 weeks from final measurement to installation. Timeframes are estimates, not guarantees, and may be affected by stone availability, freight, weather and site readiness. We will keep you informed of progress and notify you promptly of any material delay.

Installation

Installation is carried out by Apelux's own crew. Our scope covers the supply and fitting of the stone surfaces described in your quote. Unless expressly included, the following are not within scope:

  • plumbing, electrical and gas connections or disconnections;
  • removal of existing benchtops or tiling, unless quoted;
  • cabinetry, substrate or structural work by others; and
  • making good of adjacent surfaces beyond the installation area.

You are responsible for ensuring supporting cabinetry is level, square and able to bear the weight of the stone.

Title & risk

Risk in the goods passes to you on delivery or installation. Title remains with Apelux until you have paid in full. Until then, you must not on-sell or encumber the goods, and we may recover them if payment is not made. This clause creates a security interest under the Personal Property Securities Act 2009 (Cth), which we may register.

Cancellation & changes

Because each order is made to measure, cancellation or changes after fabrication has begun may incur costs. If you cancel:

  • Before fabrication — your deposit, less reasonable costs incurred (such as design time), is refundable;
  • After fabrication has begun — the deposit is non-refundable and you may be liable for materials and work completed to date.

Custom-cut stone is not eligible for change-of-mind returns. This does not affect your rights under the Australian Consumer Law.

Warranty

We warrant our stone and workmanship as follows, from the date of installation:

  • 25 years — structural integrity of the porcelain stone against manufacturing defects, delamination, water damage and UV fade;
  • 10 years — mechanical components we supply (such as fixings); and
  • 2 years — installation workmanship.

Warranties cover normal domestic use and require the care guidance below to be followed. They exclude damage from misuse, accident, impact, abrasive or unsuitable cleaning products, structural movement of the building, or work performed by others. The structural warranty is transferable once to a subsequent owner.

Care & liability

Porcelain stone is highly durable but not indestructible. You should use trivets for very hot cookware, avoid striking edges with heavy objects, and clean with pH-neutral products. A full care guide is provided on handover.

To the extent permitted by law, Apelux is not liable for indirect or consequential loss. Where liability cannot be excluded, our liability is limited, at our option, to repairing, replacing or refunding the affected goods or re-supplying the affected services.

Intellectual property

All design drawings, plans, specifications, photography and website content remain the intellectual property of Apelux unless otherwise agreed in writing. You may not reproduce or use our drawings for fabrication by another party without our consent.

Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) that cannot lawfully be excluded.
